KENNEWICK, Wash.--Donald Schalchlin will be tried as an juvenile. Shortly after the decision, Donald entered a plea of not guilty to Rendering Criminal Assistance in the first degree.
At that time, Commissioner Joseph Schneider, asked Donald if he knew what his rights were in pleading not guilty. Donald said yes.
Donald's attorney asked the court for money so that she can hire an investigator. The Commissioner wanted to wait, saying police are still working on this case.
Benton County prosecutor, Nanette Dockum, announced the state's decision earlier this afternoon.
"A hearing finding an order for decline of jurisdiction retaining juvenile jurisdiction on a charge of Rendering Criminal Assistance in the first degree," said Dockum.
Now Schalchlin is not of the woods just yet. The prosecutor mentioned that because the investigation is still on-going, the state reserves the right to re-file or modify on a different charge.
If additional charges are filed, we could revisit this process all over again. Meaning another hearing could determine if Schalchlin will be tried in juvenile or adult court.
